How do you make a citizen's arrest and can a felon make one?

  1. if you call the police out for a misdemeanor crime that did not occur in their presence you can request that someone be placed under arrest by you as the citizen.  you will be taking the responsibility for the arrest.  the police officer will only be there to assist and cuff and transport.  the officer should have paperwork for you to fill out and sign regarding the sections that laws the person had violated to warrant an arrest and then you have to advise that individual that you are placing then under citizens arrest and for what violation.  more than likely they will only be taken to jail, cited and released.  however... the officer is not required to go along with the citizen arrest if he/she thinks it is b.s.  and yes.... a fell can request someone to be placed under citizens arrest... just because you are a felon does not mean you have no rights as a citizen.

  3. I think a citizen's arrest is when a non policeman says:  you're under arrest.  

    That's about all there is, but then you have to figure out how to make them stay until the police actually come.

  4. Anyone can make a citizens arrest. You just have to an accredited witness for the crime you are witness to.

    All you have to do is somehow make it clear to the subject that he is not free to leave, either by verbal or physical means. Keep in mind that in many states you can usually only perform citizen's arrests for felonies, not misdemeanors (i.e. you can't tackle and hold somebody just for trespassing in your driveway, unless he was also trying to break into your house).

  6. technically a felon would be a fugitive as well and would get busted but if you mean ex con you are in the clear, Now for the citizens arrest part, that means that you detain them until the cops arrive, you take them to the jail and file the charges with the DA, or you take them directly to court or the police station.

    And also note a citizen can arrest a cop for commiting any crime including speeding without his lights and/or siren.

  7. a felon as in someone who is currently a fugative from justice can but then they'd risk going to jail too. a felon who just has priors can without a problem. in 49 states all you have to do is tell the person they are under arrest. you dont even have to use the phrase "citizens arrest" if you dont want, but its usually better to use the phrase "you're under citizens arrest". once you say that they are under your custody to be taken to the nearest police station. if they resist, you can add resisting arrest to the charge. but if you put them under arrest and they haven't broken any law then you can be arrested for false arrest. The only state that doesn't allow citizens arrest is North Carolina, but you can still lawfully detain someone if they've committed a crime (which means you can hold them and wait for the police to come get them).

  8. You see a crime in progress and apprehend the offender using reasonable force. Felon or anyone else can do it.

    Personally I wouldn't recommend it...if you think cops get sued , then think about how often a citizen who doesn't know the various laws on detention and use of force gets sued or charged 'cos they assaulted the crim, or someone they thought was the crim.
