Question:

How do you sue the post office??

I wanted to sue the USPS in small claims but:

1) can I do that, since is a Goverment branch?

2)where do I sue them?

3)where/who do I serve the court papers?

  1. To sue a government entity, you would first need to file a notice with the government that you intend to file a claim against them.  It's only after that when you would be able to file the actual law suit against the government.

    If the paper wasn't filled out right, you might be able to get your postage returned, but no damages or losses for the lost item.  Sorry.

If the amount your suing for is enough, hire an attorney.  If not, write it off as a cheap lesson and next time make sure there are no errors.  (If you win you get a judgment for the value of the package, but not for the legal fee, which will be a percentage of the amount you get.  And no attorney is going to take a case that will net him 1/3 of $1,000.)

  3. Depends on what it is for. You can sue the post office for some things and not for others. If they deliver mail and it is damaged or lost, you dont have a case. If the put mail on your steps and you trip and fall over it, you can sue them. IF you think that you have a case then you need to serve the local post master personally.  

  4. Not to be nosy but...why do you want to sue?  

    However, the answer is yes you can sue.

    Go to your courthouse and file papers with the Small Claims division.  It's as simple as that.

    Just make sure it is something that is truly an issue that won't make you look bad in front of a judge.  They really look down on frivolous suits.

  5. It would be a waste of time because you would not prevail as it was your responsibility to make sure the paperwork was in order before you left the post office.
