How does a background investigator obtain a person's confidential Pyshcological records from a Pyschologist?

  1. There is the legal method, and there is the illegal method.

    The legal method includes showing just cause reason why they should have access to the records.  For example, if you authorized the investigation & signed papers saying they have access to info about you, for them to show to various places.  Or if the investigation was authorized by the government, it may come with subpoena power.

    The illegal method involves the investigator staff telling some lies to the psychologist staff, or breaking into their records, easier nowadays on computers, than when the records were physically stored in locked file cabinets.


  2. yes they can get anything...not legally (yet) but they can get it.

  3. HIPAA rules.  Can only be released by parental permission, Court Order or as required for evidence in a court case.

  4. Those records can't be obtained without the patient's permission. Laws strictly regulate this.

  5. They either show up at the office or fax a copy of the medical record release form you signed when you applied, and the doctor gives them the records they requested.

    Happens all the time.
