  1. None of these. You must be referred for testing. The test results will categorize your learning ability.

  2. Your sympathy and empathy for special needs kids is is severely lacking. I find you attitude offensive.

It seems to me that taking some sensitivity training might be beneficial. It is no fun to be disabled and special needs kids would give anything not to be disabled. I remember a child with Traumatic Brain Injury who must wear a helmet because of balance issues saying, "I wish I could go back to the day before the accident."

Contrary to your understanding, many special needs children are not "stupid" at all and may be gifted. We find this all the time among children with learning disabilities. There is absolutely nothing wrong with their brains, but the wiring that brings information in is problematic.

Also, contrary to your opinion, most special education students don't misbehave in their classes at all. It is only when teachers fail to accommodate their disability or when mean students tease them, that you see misbehavior.

As other people have said before, the only way to get into special education is to be tested and found  to be deficit in some way. While you are deficit in the area of empathy and concern for people less fortunate than yourself, it doesn't qualify you for special education.

Why don't you turn things around and offer to volunteer in a special education classroom so that you can develop an understanding of what it is like to be handicapped? It isn't fun and it isn't something special needs kids decided to bring upon themselves. It will enhance your on growth as a human being.

  3. The way the student becomes a special ed student is for the school and the parents to follow the step by step process in the FEDERAL law called  IDEA  'individuals with disabilities education act'

I think what you are asking is what problems does a student have to have in order to become special ed.

It can be any problem that prohibits the child from progressing educationally.

The things you listed above do NOT qualify a child for special ed. The child can do ALL these things and still not qualify to be a sped student.

  4. e. none of the above

A child needs to receive appropriate professional testing by a panel of professionals in all areas. If they are found to have a disability then they should receive the correct services

  5. I understand your question and I choose d. All of the above.

I know some kids are instructed on how to act in order to be referred for services.  It's called cheat the social security system to get a monthly check.  If you are in a poor school system, it's pretty easy.  If you have a wise psychometrist and teachers who aren't duped that easily, it's not too easy.

Our district has a building based student support system (BBSST) which requires a lot of prereferral interventions and tons of documentation & paperwork from overworked teachers, before kids are referred for testing.

  6. a combination of all of those things will lead the teacher to refer the student for evalation.  Then after a team evaluates you they decide if you belong in special education or not.  You can;t just say this child belongs in special ed and put them there.
