How does a right of way effect property value?

i own a house and 5 acres. my brother owns land above mine and wants me to give him a right of way. this right of way would go right beside my house. if i decided to sell this house would this affect the value?

  1. Well, it would lower the value at least some.  And increase the value of your brother's property.  How much would depend on your location and how intrusive the right of way is, among many things.  Contacting a real estate agent would be a start in putting a value to it.

    If you just want to help your brother out without a financial transaction you could also grant him a right of way contingent on both of you continuing to own your properties.  That by itself wouldn't lower your property value.  And if your brother sold, you could either refuse the right to the buyer or charge him for it.

  3. Depending on where the right of way is located on the property it could greatly reduce your property value, while greatly enhancing your brothers
