  1. the adulterer gets sc**ed. At least, that is the theory

It amkes more money for the lawyers and practically nothing else.  The lawyer of the injured spouse will tell that spouse that they can "get more" if the case involves adultery.  Both parties will pay their attorneys huge amounts to claim and defend from claims.  In the end each party will be drained of funds which could be used for their children and end up settling for 1/2 like everyone else.  Best to come to terms and write it down, hire ONE attorney and file the papers.  Anything else is just money in an attorney's pocket.

If someone has had infedelity in the marriage and the other person knows and has proof of this it can make the divorce very messy for the person who did the cheating meaing if it was the husband that cheated the judge will run him through a meat grinder persay.  Divorce Courts do not like adultery as the reason for the divorce and will take the adulterer to the cleaners if possible.

  4. In most states it doesn't.  Most states have No Fault Divorce laws, meaning that you can get divorced for ANY reason -- like "Irreconcilable Differences".

    But you should check with a lawyer.  There are still laws on the books in some states that makes infidelity (adultery) a reason for divorce, and the one doing the "cheating" will get less of the settlement.
