How does my husband go about adopting my kids???

I have been married for six years and i have four kids two with my husband now and two with my ex.My son is 9 and daughter is 7.My ex hasnt seen my kids sceance my daughter was 3 weeks old.I have been with my husband now sceance my daughter was 5 months old she doesnt noone her real father niether does my son.I havent spoken to him in years he could be dead for all i now.My husband wants to adopt my two kids but were not sure how to go about doening this ? We live in new jersey and i heard the rules hear are harder to get around does anyone have any idea how i would do this???

  2. Call your local Probate Court, they will give you all the details on how to do it.

  3. The easiest way would be to find the dad and have him sign away his rights. Did you ever get a child support order? If not get one, it;s good leverage when you approach him on signing over the kids. You will have to show that you tried to find him before an adoption without his consent would be considered

  4. I think the birth father need to give up rights to your kids. I'm not sure though.

Step-parent adoptions happen all the time.  The way it goes is usually that you and your husband submit the papers at the courthouse, and a court date is set.  Your ex is served notice that the hearing will happen.  He likely won't show up to contest the adoption and if he does then he has to make a very good case that his rights shouldn't be terminated and if he has not been paying child support then he has no case.  go down to your county courthouse and they'll give you the papers and instructions you need to get this going.
