How does this voluntary removal work?

I am asking for a friend of mine who doesnt understand what is going on and I cant seem to find anything on the web about it.

Friend is from Mexico and was picked up by INS no criminal history and was ASKED to sign a paper to voluntary leave.

He had all his medical workup and is expected to leave this week. sitting at county for 2 weeks now.

Waived right to court hearing etc.. INS will be transporting him back to mexico.

I have read about vol departure where they give you so many days to leave on your own. So what is difference here?

He signed a paper to vol leave, but INS is transporting. I cant find anything on any other web sites to explain this.

  1. i think the new voluntary departure thing is for people who have not been "caught" by immigration, if your friend was picked up by INS and signed the paper to leave w/o hearing he just has to wait until transportation becomes available.


  2. Too many under voluntary deportation failed to leave when not in custody. The USCIS and ICE are a bit more cautious now.

  3. Some illegal aliens are given the opportunity to put their affairs in order and then allowed to leave on their own.  Others, who agree to voluntary departure, are held in detention and transported by ICE.

    Obviously, ICE does not believe this guy will actually leave if they set him free.  Most don't.
