How far back do new employers check ?

I resigned from a job 3 years ago due to bad blood after 21years with this employer. My attorney requested a copy of my personnel file and there is nothing in the file to indicate bad employee- no disciplinary action ever. I have been working for a new employer for 3 years, but now I am looking for a new job. How far back do perspective employers check work history. The head of HR in the old company knows the history and could potentially say something that is not in my record that could jeopardize my future career if called upon. Could I file a law suit if I find out that something was said that is not in my file?

  1. Most employers check 7 - 10 years.  If they're government affiliated, they'll check further back.

    Also, to avoid legal issues, most employers will only provide the start and end date as well as your job title.  

    Salary, reason for leaving, rehire eligibility are not as common since several companys' policies do not allow them to disclose this information.

    You could check with a lawyer to see what the laws are in your state should your previous employer disclose any information that is incorrect or an invasion of privacy.
