How fast can I get my husband back into the USA legally?

My husband is here illegally and he needs to return back to Mexico after 9 years for a family emergency! He is our main financial resource for our children and pretty much our household! We haven't yet started the process to change his status here but after this family situation it is urgent that we do something! I know it takes a long time but I need advise or simple answers. How long would it take for him or myself to get him a permit to come back to the USA legally? Would the fact that he pays taxes help him in any way? If it takes a long time then he will just stay here and not go to tend to his emergency!! This is all soooo frustrating!! SOMEONE PLEASE help!! any answers and suggestions will be greatly appreciated!! ... Thank you in advance!!

  1. he has to apply from the country he belongs in, he should not have been here in the first place!!!!!!!!!! He may have a 10 year ban on him to return if we are lucky.

  2. If you file the paperwork tomorrow (I-130, I-864 and G-325A), and there's no problems, and his waiver of inadmissibility (I-601) goes smooth.... 18 months.

    There's literally 1,000,000 people in the line in front of him.  If he wants to live and work in the USA legally he'll have to wait his turn to have his case adjudicated.

    The worst thing he can do is try to smuggle himself over the border.  If he's gets caught then he'll have a record of multiple illegal entries.  It will greatly complicated his case should he ever decide to comply with US immigration law.

  3. well it's not gonna be that easy and that fast, since he was here illegaly for 9 years there's a big possibility that his case can be denied, if he's gonna leave the US then you should petition for him, get him a K-3 spouse visa, usually those visas take like 3 - 6 months to be processed, after that he would have to send the immigration forms to apply for a work permit and permanent residency, the work permit would be like 2 - 3 months after you send the forms and the green card like 6 months the shortest up to 1 year or 1 year and a half.
