How is the fight to bring back Homeschooling in California doing?

  1. Let's get clear about something.  Judges cannot outlaw anything.  They only interpret law.  It is the Legislature's job to pass laws.

    Currently, there is a Resolution (ACR 115) gaining support within the California Assembly.  This is not legislation.  Is is a resolution calling upon the California Supreme Court to overturn the lower court's ruling.

    In addition, the Superintendent of Public Instruction has issued a statement saying the ruling will not be enforced.

    The fight is not to bring back a right.  The fight is to keep a right we already have.  And we are winning.  :)


  2. It was never outlawed - it was a faulty ruling on a 50yo law.  Both the governor and the state superintendent have publicly sworn to see it overturned.

    Homeschooling in CA hasn't changed - the ruling is being appealed and there's a petition out to depublish it - it won't stand.

Well, the judge issued his opinion that parents didn't have a constitutional right to homeschool, that doesn't actually outlaw it.  The governor of California and even the California state department of education have stated that homeschooling is still legal in California.  The danger is that the case could be used to set legal precedent *if* another family is every brought to court over homeschooling.  That is why it is so important to depublish the ruling, if it is depublished it will have no effect outside of the one family involved in that one case.

             There is no debate about canceling homeschooling. For more information, do a search of resolved questions on the homeschooling message board.

          Jack O'Connell announced today that the California Department of Education has completed a legal review of the February 28 California Court of Appeal ruling regarding home schooling. O'Connell issued the following statement:

          "I have reviewed this case, and I want to assure parents

          that chose to home school that California Department of Education policy will not change in any way as a result of this ruling. Parents still have the right to home school in our state.

          "Every child in our state has a legal right to get an education, and I want every child to get an education that will prepare them for success in college and the world of work in the challenging global economy.

          "As the head of California's public school system, I hope that every parent would want to send their children to public school. However, traditional public schools may not be the best fit for every student. Within the public school system there are a range of options available.

          Students can take independent study classes, attend a charter school, or participate in non-classroom- based programs. But some parents choose to send their children to private schools or to home school, and I respect that right.

          "I admire the dedication of parents who commit to oversee their children's education through home schooling. But, no matter what educational program a student participates in, it is critical that

          the program prepares them for future success in the global economy. I urge any parent who is considering or involved in home schooling their children to take advantage of resources and support available through their county or district offices of education."

  9. That judge made a ruling that isn't a "new law" and fortunately, thanks to checks and balances among other things, if it did become law, our governor would not sign it in...

    Thankfully there is enough support for homeschooling that even if it did become law, there are MANY who would fight it.

  10. I heard on the news today that it was unconstitutional to homeschool your kids in California.  That is unless you have a teaching degree in every subject that is taught.  The liberals are happy about this.
