the last few days the complex I live in has been cleaning the units. basically doing some painting, cleaning the carpets, and cleaning the ovens. today when I was checking out the kitchen area i was noticing that some of my property had been stolen. i told one of the people who was cleaning the oven that someone had stolen something and i was going to call the cops and file a theft report.

so now the two people who were cleaning the oven basically totally freak out and start gathering up all their stuff and move outside into the hallway and bail. then their boss comes by about 10 minutes later and says he's sorry someone that works for him stole my stuff but I wasn't getting it back. i basically told him to get the h**l out of my apartment and to ***** off.

then the boss guy starts bitching and moaning and talking all this **** bla bla bla. I think he was pissed because some of his workers are illegal aliens and he might get in trouble if the cops show up.

cops never showed their face and the apartment manager just laughed at me when i told them the story. Never got my stuff back but I'm pretty sure that worker was fired, which is fine with me.

  1. Keep calling the cops until they come out and make a police report. If you have renters insurance, you can file a claim,

  2. Apartment managers are not responsible for the contents of the apartment that you are living in.  The police are also not responsible for any contents of anything that you own.

The way that renters law and legal liabilities go, is this.  The Apartments Management Company is responsible for providing as a business the amenities and utilities of the apartment.  Meaning that they must ensure that the AC works, there are no fire hazards and that the building is up to par with the building code of your county and or city.

Now as far as personal effects and burglary laws.  If you were not at home or you were home and an uninvited guest, that did not know you and has never been over your house, and whom you have never criminal trespassed from your property, stole something it would be called burglary of a habitation.

However the workers that were in your house, are basically free game to steal from you under this law,  and depending on what type of things that they had stolen then it would be called simple theft.   It would not be called burglary becuase of the situation.  You invited them into your home to do business, and they stole from you.   If you caught them with the items, or had video evidence of the theft of the item that you could show police then you could honestly have a case that would hold up in court and have the person tried for theft and then burglary of a habitition as well, if the judge would allow it.

Word to the wise.  I have Renters Insurance for in case my apartment gets broken into.  My computer is covered against lightning strikes and such, as well as all of the contents of my home are secured and listed by serial number so that they can be tracked down if they are stolen.

Only high dollar value items though.

For anyone that has anything of value, I would recommend that you take digital pictures of all jewelry from at least 3 angles and also give a weight amount for them.  Catalogue all your jewelry that is gold and silver.

The next thing, all TVs, washer and dryers and just about anything with a serial number that you know will be lifted,  Engrave your last name and the last 4 of your social security number and or Drivers license on the back of them in a conspicuous place.

The next thing that you need to do to secure your home is set up some cameras both inside and outside,  they are cheap and you can keep a video log of everything that goes on out there and in htere while you are gone.

I sell security systems and installations for residential and commercial customers as well as apartment buildings.

The other things that you need to do is get renters insurance, that way you can get those items back that you would need replaced if a guy that is doing the floor takes the sofa and the TV with him.
