How long can thay hold someone without posting bail?

My friend has been arrested since 8 am, no bail has been set, how long can they hold him in GA without bail if he has no priors and is not on probation

  1. Well, they can hold anybody for up to 24 hours. During that time they will either release him or charge him with a crime. The bail is usually posted shortly thereafter, as usually a day or less.


  2. In California it is 3 working days that someone has to be arraigned in court.  If they do not get arraigned within those 3 working days then they have to release them but be warned that the District Attorney has up to 1 year to file charges against him and that at any time they can do it without even notifying him of it.  

  3. Federal law, which has the bare minimum requirement for the states to follow, sets the maximum amount of time for a person to be held without seeing a magistrate as being 72 hours.
