Also would I be eligable for a Spousal Visa cos me and my girlfriend would be a g*y marriage?

Sorry, but "Homosexual Marriages" are only recognized by some States, and not by the Federal Government. I can not see you being issued a "Spouse Visa" in a same-s*x relationship. But good luck with that anyway, I wish you the best!

A K3 visa is valid for 2 years from entry to the US I believe, but you really should be looking to file for Adjustment of Status as soon as you can to allow you get an EAD and SSN.

Federal Law does not recognize same-s*x marriages, only the laws of certain states. The Immigration and Nationality Act and the Code of Federal Regulations (both of which make up immigration law) are federal legislation. There are no provisions in either statutes which allow for a same-s*x partner to be treated as a spouse when it comes to immigration benefits or applications.

K3 is not granted based on same gender marriage. US Immigration Law doesn't recognized same gender marriage as the marriage.

As I told you before:  The US Federal Govt does NOT recognize same s*x marriage.  As a result, in your situation, there is no spouse visa available if you marry your girlfriend legally anywhere.

Only the state of Massachusetts and California are currently allowing same-s*x marriage... and California might make it illegal again soon.

Your future spouse would have to live in one of those states if you plan on marrying her.

Also know that if you're 15 as you have stated on your profile then you have to see whether it's legal to marry at that age in the state you wish to marry in.
