How long do I have in the eviction process to leave the rental house?

In michigan. Also, can my stuff be confiscated?

  1. Have you been served with a 3 Day Notice to pay rent or quit, which is the same as a 72 hour notice or a 30 Day Notice to vacate? If you are served with a 3 day, you have 3 day's from the time you are served to pay rent or they can then file in court on you. After the 3 day's are up the landlord is no longer obligated to take your money and can then file a claim against you in court. It usually then only take around 3 week's to get a court date. You have the opportunity to show up in court and present your case as to why you didn't pay the rent. Then the judge makes the decision to either allow you to pay and stay or tell you exactly what date you have to be out by. If you are served with a 30 Day, you do not have to pay the landlord one more dime and you have either 30 day's before they can file for a court date and again you can wait and show up in court to present your case. If you are in the wrong though and you know it, my suggestion is get packing and move. You don't want a court judgement against you because then no one will want to rent to you after that. For more answers in your particular state, call your local Housing Authority Office!  


  2. They can give you a week; they can give you 30 days. It's to their discretion I believe.

    And yes, if you are evcited and do not move out by the eviction date they can confiscate all your things and sell them off at auction.  At that moment you are no longer allowed to retrieve your items from your house because it would be considered trespassing.  Unless the landlord gives you permission. My suggesttion?? Be NICE to the landlord and you may get much further than some others.
