How long do I have to take someone to small claims court in Ontario??

ok, long story short, i have an old roommate that owes me some money, and i had misplaced a letter she had signed, but recontly found it after moving, and i was curious to know how long i have .. or had to take her to small claims.

  1. The Ontario Limitations Act. 2002,  http://www.e-laws.gov.on.ca/html/statute... came into effect January 1, 2004. It states that for most cases (their are a number of exceptions) any cause of action that takes place since January 2004, you have two years from when you discovered the claim to sue.

    The prior Ontario Statute of Limitations, 1990, and other legislation gives various limitation periods. For most contracts where the cause of action was December 31, 2003 or earlier the limitation period is 6 years.

    You may want to retain an experienced licenced small claims court paralegal to assist you.
