Our divorce was final August 8, 2008. He has 5 items in my house he was awarded, it was ordered that I was to release these things in a timely fashion. He has made arrangements 3 times to pick them up I have them boxed up waiting for him in my living room and all 3 times he has come up with an excuse not to show, do I have to keep holding on to them or can I just set them out the next time he says he is coming and what ever happens to them happens?

  1. I would send him a registered letter giving him thirty days to pick up the items from the date you send it.  cc your attorney and his.

  2. timely to me means 30 to 90 days.  just box that junk up and put it in a corner.  After 90 days SELL IT!!!!!

  3. Since it was court ordered hold on to them.  Otherwise he would have valid reason to take you to small claims court and collect from you.  Call the court that issued divorce and his items then explain what is happening.  They may be able to set up arrangement for him to definitely come the next time.

  4. Send his stuff to his new place or his parents place via FedEx or something.  Get a signature and voila, you have honored the judgement.  Bill him for the courier.

  5. Send him a certified letter with a return receipt advising him of your intent to hold these things for him for 30 days and that you will dispose of them if he has not picked them up within that time frame.

Honestly, I would just move them to the garage or some place out of plain sight so I didn't have to step over them.  He apparently doesn't think much of the things or he would have picked them up before now.  It's been almost a month already.  But if he still doesn't pick them up, I would either sell them, give them away or throw them away.  You aren't his own personal storage facility.

  6. What is your problem?  Either drop them off at a relative or mail them to him.  Why is it so important that he personally come and pick them up?  Do you really think he wants to come around?  Until you get over this anger/I want to get back at him attitude you will never be happy.

Don't you see your 3 children that your husband has full custody of?  Seems to me that that would be a perfect time to transfer his stuff.

You did say that you wanted the 3 kids to know their half brother (product of you and your boyfriend), so you must be in communication.
