How long do they hold someone for a warrant???

I am so scared. My BF just called me and said the police came to his work and picked him up for an old warrant. I don't know what to do. He said they are going to take him down and hold him for arraignment in the morning. I am so scared, can they old him longer? I'm 4 months pregnant and I am soo scared what if they keep him and what if he gets fired, why would they go to his work aren't there major criminals in the state????

  1. They hold him until the arraignment.  At the arraignment, the Judge will either set bail, or order him held until trial.  Since you say NOTHING about what the warrant is for, anything we say about his chances of bail is an UNINFORMED guess.

    To the SELF PROCLAIMED officer that said 'people are always notified when a warrant is issued against them', that is a DUMB comment.  If they no HOW to notify him, they can EXECUTE the warrant (aka arrest him).

A warrant is an order signed by a judge to bring someone to court.  There is a bond amount assigned to that warrant.  What this means is that they can hold him until his court date, or he can make bond.  Bond is money put up to guarantee that he will show up at court on his scheduled date and time, or he loses the money and another warrant (with a bigger bond) is issued by the judge.  

    If his arraignment is in the morning, then he goes before the judge in the morning to either plead guilty or not guilty.  If he pleads guilty the judge assesses a fine at that time and he is offered several options on how to pay the fine, again he could make bond.  If he pleads not guilty, then he is given another court date, this time for a trial, and again he can either sit in jail until that court date, or make bond.

    Why would they go to his work?  Because he showed dis-respect to the judge and the court system by not showing up for his original court date.  These failure to appear warrants and court cases are what keeps the courts back logged.  Police departments have started a fugitive (that's what he is) unit designed to track down anyone who has an outstanding warrant, and pick them up.

    The age of the warrant is irrelevant.  His activity at the time of the warrant arrest is irrelevant.  What he did to get the warrant is relevant.

  3. It all depends on the charges and whether or not you can bail him out.  If the judge sets bail at his arraignment, then you can get him out.  If not, then he stays until his next court date.

    Go to the arraignment in the morning, if you can, and find out if the judge sets bail.

    They picked him up at work because they knew where to find him.

First of all, people are always notified when a warrant is issued against them, so I question that you say he didn't know (unless he moved and didn't change his license etc.).  If he will be arraigned in the morning, more than likely they will decide on bail, depending on the charge.  If it's a serious charge or he is a flight risk he may not get bail and may have to stay in jail until his court date.  If he is given a bail amount and no one can pay it he will also stay in jail until his court date.  I wouldn't question why they would go to his work and that "major criminals" comment is uncalled for.  Your boyfriend obviously did something illegal, that's why he got a warrant.  The police are supposed to uphold all laws, not just the "major" ones.

  7. Well the holding duration might very well depend on the original charge which you failed to mention in your question. Then depending on the charge, they will set a bail amount in order that he be set free. After of course the bail amount has been posted.
