  1. You should file a claim right away.  Just call the at-fault carrier , and let them know that you were injured.  A delay in filing may send up a red flag.  

    MA is a No-Fault state.  You have PIP coverage of your own.  This coverage will pay for your medicals and 75% of your lost wages up to the $8k policy limit.  You must go through your own PIP coverage for the reimbursement of these expenses.  Once you have stopped treating, your insurer will subrogate for what they paid out.  

    You have three years before the statute of limitations expires to file a lawsuit.  

    FYI - MA has a monetary threshold before you can be compensated for "pain & suffering".   Your injury must be serious - fracture, scarring and/or permanent.  If you sustained a whiplash injury only, you must incur $2k in meds before you can file a claim for bodily injury.
