How long do you have to make a claim after accident??

I got rear-ended a year ago. Immediately after the accident, I had a headache and general soreness. Within a month I had some shoulder pain, thought it would go away, through the past year I have went to the Dr. for numbness, and shoulder pain. I have documented with the Dr.s about the auto accident. I did not want to try to get any money out of insurance because at the time I did not believe I needed it, but now, the pain has just not gone away, and I am concerned I have a serious shoulder injury as a result of the seatbelt going across that shoulder when rear-ended. I did not sign anything stating I was ok...etc. I am 24-years-old, no prior injuries.

  1. it depends on where you live and what you said to the cops after the accident in some cases you can report it up to 3 to six months once the accident was reported properly ,call an injury lawyer i knew someone who filed a claim three month after the accident and won a settlement in New York


  2. A year is along time. I guess your going to have to call your insurance company to find out.

In NY you have only 45 or 90 days, I think, to file a claim for injuries under your no-fault coverage (aka personal injury protection), which is the primary coverage for injuries to yourself and the occupants of your car.  If your state has similar rules and you can no longer collect under no-fault then try contacting an attorney to see if you can file a lawsuit for your injuries.  Lawsuits would get paid from the other driver's liability coverage, which is a separate coverage and has different and usually looser rules regarding time frames for reporting claims.

  4. Go ahead and file the claim.  The adjuster will review your policy and determine how your coverage applies to your claim.
