How long do you have to sue workers compensation?

Been hurt at work, they've been paying the doctors bills, but haven't done anything to find out what is wrong.

  1. You can't sue workers comp, unless they deny the claim.  You can CONTEST it.

    It's not up to workers comp to "find what's wrong".  It's only up to them to pay medical payments and lost wages, for work injuries.  

    If you've got "something wrong", you need to go to your doctor.  THAT'S who finds out "what's wrong".  But workers comp won't pay for it, unless it's work related.


  2. I think it's dependent on the state. Do an internet search for your specific state to see what the requirements are.

    An employee just filed a suit against the company that he was employed by in the 80's--fortunately for us, it was long before we purchased the company.  

  3. generally it is 2 years after the occurrence of the loss and depending on how disabled you are, you only qualify for permanent dissability if you loose a limb or your eyesight. But if you are looking to sue for pain & suffering it can be very costly for you and you will need a lot of supporting documentation.

  4. We'll if they are paying your bills than you really have nothing to sue, what other benefits that you are missing?  Work comp injuries take awhile to go through.  It's quite often doctors will diagnose things that are right at first but than other factors come into play.  I'm guessing the reason why it still hurts could be degenerative problems, or a wound not healing right at all.

    I have claims where claimants just get attorney's to help them with the process, but if your going to the doctors and the adjusters are paying your bills you really got nothing to sue.  Eventually you'll see that light at the end of the tunnel. You can always ask your adjuster regarding the claim, ask questions.
