After you file, how long does it take for them to notify your creditors and them to stop calling and harrassing you? I'm filing chapter 7.

  1. It should stop in about a week to 10-days.


  2. I live in Aus - sent paperwork away - 48 hours later my creditor was notified and no more harrasments.

That depends on your lawyer's office and when they decide to get their work done LOL.  Since you've already filed though, if they call just give them the name and number of your lawyer and tell them to contact them.  Legally, after you tell them you've filed and given them the contact info they cannot contact you anymore.  At least, that's the way it was when I filed in 1998.

Under Chapter 7, creditors and the trustee have a 60 day period from the 341 meeting in which they may challenge the debtor's right to a discharge (Bankruptcy Code § 727) or the dischargeability of a particular debt (Bankruptcy Code § 523 (a) (2), (4), (6),and (15)) by filing an adversary proceeding.

    Unless an action to deny the debtor a discharge is filed, the order providing for the discharge of debts is issued by the court shortly after the 60 day period expires. The filing of a contest to the discharge of one debt does not prevent or delay the entry of a discharge of the balance of the debtor's debts.

    With the new rules in effect are you aware that debtors in cases filed must complete a course of financial education from an approved provider in order to get their discharge. The class is generally several hours and is available online from several providers.

    Failure to get the class and file the certificate of completion of that class can result in the case being closed without entry of a discharge. The court may charge a new filing fee to reopen the case, file the certificate and enter the discharge.

    So in essence, the answer to your question would depend upon the following:  how long it takes for you to get your certificate plus 60 days, that is how long it would take.

  5. immediately you have to notify them(creditors) that you have filled bankruptcy you will need your case number, attorney's name and number and the date that you filled. so if they call you let them you have filed and the calls need to stop if they continue to call you can take legal action, under the fair debit collection act.

  6. about a week. Then they can not contact you at all.
