  1. Depends on if the estate is in probate, if there was a will, etc.  Need more details.   If no probate and  no will, the bank usually freezes it for 30 days to give all checks a chance to clear before releasing the funds to the survivors of record or beneficiary.


  2. It can take up to 18 months. In my experience, nothing goes through the Probate Court in less than 6 months. I've seen it take more than 2 years on rare occasions. Normally 12 to 18 months is what I see.

  3. It really depends on the state.  You should consult a lawyer in your area.
