How long does it take to get a car settlement???

I dont know exact details about my boyfriends settlement, but exactly how many years can it take for a settlement to be finalized, its been probably 2 to 3 years already I think, he is dealing with state farm insurance, and they keep going to court to fight it. How much longer can we expect?

  1. Every Insurance company in the United States is required by law to either reject a claim, or make a reasonable settlement offer within 60 days of notice of the claim.

    On property damage to a vehicle this is pretty cut and dry and no attorney is needed.

    Most attorneys will not even accept an auto accident case unless their is a personal injury claim. A property damage only claim makes no income for an attorney.

    If it has been 2 years and your boyfriend was truly injured and not just claiming phantom injuries such as the common soft tissue injury types, Then most likely the insurance company has already made settlement offer 3 times or more and the attorney has rejected them.

    It is up to the claimant or his attorney to accept or reject any settlement offer.

    Your boyfriend needs to talk with his attorney to settle the matter.

    Unfortunately it sounds as though your boyfriend hired an attorney, sued for personal injury and signed all his rights over to that attorney. He's probably been seeing a "Chyroshyster", pardon me I meant "Chiropractor" which everyone knows is not a real doctor. Any insurer and any court would know that if he is really injured he would need a Surgeon.

    The first thing that an attorney does after filing suit is to file a waiver with the court of the clients right to compensation within 60 days. This is a common strategy on the part of most ambulance chasers, Oh Pardon me I meant "attorneys" in an effort to bleed the insurance company. They think that the longer they drag the case out in court the more likely they will be able to rack up legal fees that the attorney will be paid in any eventual settlement.

    The reason it's taking so long is not the Insurance company. The attorney is responsible for your delays. So basically it will take as many years as your boyfriends attorney decides to continue to drag it out.
