how long does it take to get a court action to sell heir property when it cannot be divided equally among the heirs

  3. It depends on many factors, did the deceased leave a will, what state do you live in and is anyone contesting the will?

    I have a friend that has been going through this for a little over a year. She is one of three children, (they are all grown now), but one of the three, passed away unexpectedly last year. He has no blood relatives except for his two sisters and he left no will. No one is contesting anything, but the law in our state, says you have to go through probate in order to divide the assets. The two sisters are in total agreement as to what needs to be done with the house and such, but by law, they cannot sell the house or anything else, until it gets through probate.  

  4. Depending on local rules & custom, if everyone agrees, it can be done in one day -- but everyone's signature on the motion or consent will be necessary.
