How long does it usually take for the insurance company to send a check regarding an auto settlement?

I talked to my lawyer about 2.5 weeks ago, and she told me that she is waiting for the check. Does it usually take this long? I hate to keep calling and seem like a pest, or some crack head.

I thought that I would have to sign paperwork before the insurance company issued a check, but last time we talked all she said is that she is waiting for a check.

I know most of you will say, "your paying your lawyer, so ask them questions". I am just trying to get an idea. Thanks

  1. Former auto claims adjuster here. Once damages to the car are taken care of, a check is sent right out. If you have injuries in the wreck, then you will need to sign a release and then a check will follow. Hope this helps.

  4. I assume that from the onset, you gave your attorney "power of attorney" to sign the settlement release.  If you did not, I am not sure why she did not call you in or send the release to you for your signature.  

    Anyway, once the adjuster receives the settlement release, the check will be issued.  Most adjuster cull through their mail every day in search of releases.  A signed release means they can issue a check and finally close the file.  Such JOY!   In some states, like NY, there are time frames wherein the settlement check must be issued.  

    I would think that you would have your settlement check within the next week or two.  Waiting more than 30 days is unlikely, but your attorney may be trying to work out liens with your medical providers.

    I had a friend who worked for a large ins co, and she told me they actually take into account for the delay in issuing checks as it affects their profits, and I believe it.

    You usually do not have to sign anything to get a check, but when you sign the back of it (to cash it), you are also singing a statement that you're satisfied with the amount and the matter is closed.

    Once you say you don't want to bother someone too much as you don't want them to feel you're being a pest, they either say it's no problem and let it go, even if you're being a pest. Once you compare yourself to 'some crack head', they loose respect and probably put your papers in the box of stuff to do later.
