  1. Depends on how booked up the court is...and how pushy your lawyer is...they can make it happen.


  2. depends on where you live.  Do you have a personal attorney or using a child support office?  Once you file for child support your attorney will send a notice explaining that they are representing you and an explanation of what you are asking for.  The defendant (ex) will either find an attorney and try for a settlement agreement or you will go on to court where a public attorney will be appointed to her/him.  It can take months so please don't be in a hurry.  The judicial process can be extremely slow
