  1. It depends on if he has established paternity yet or not. If he hasn't he probably can't appeal the adoption. Or he can try, but probably won't be successful.

  2. In theory or reality.....it just depends on how good his legal team is.

  3. It depends on the laws in your state, but typically a father can't "appeal" the adoption once it's completed.  He can contest the adoption before it takes place, but before the adoption can happen the biological father's rights have to be terminated.  He can either do this willingly or the court can decide to terminate his rights, but once it's done there's no going back.  Good luck!

  4. It depends on the state. The best thing would be to get him to sign over his rights. This way he can't fight. If the first mom says she doesn't know who the dad is the adoptive lawyer has to put an ad in the paper stating that the baby is going to be put up for adoption. The father has so long to come to the lawyer and protest the adoption. How long depends on the state you are in. You can call an adoption lawyer and they can tell you how long they have. The only way it is iron clad though is if the father signs away his rights. I know about this because, my husband and I are hoping to adopt. So I am pretty familiar with the laws.

    Good luck,

    Mother.

  5. You need to talk to an attorney in your area.

This is regulated by the laws of your state, and so only an attorney can tell you what the regulations are in YOUR state.
