The house was foreclosed upon improperly and we want a cleared title before settlement. (The title was actually suppose to be cleared before we bid on it.) Any ways apparently the seller (bank) has to re-foreclose on the property to clear the title. So now we are waiting- our new closing date is Sept 24th but as of yesterday- I found out the title is still not cleared (they have had almost 2 months). How long does this process normally take? My Realtor says she wasn't sure and the Auction house told me I am being impatient and they have till the 24th to fix it. Seller is giving up NO information which is a lawyer so I can't understand her textbook talk half the time. I just want to know realistically is this something that can be done is a week and these people are fooling around or does this take MONTHS to fix.

  1. every state is different.  What state?

  2. Persistence

Banks are notoriously slow in dealing with foreclosed homes even though it's not in their own best interests

They have to go to court to get a deed--has that happened?

Don't you have an attorney to talk to the seller's attorney?  Get one, this is biggest purchase of your life, and they can push better than you.
