How long to get a claim from the insurance?

I had a car accident couple of months back and my own solicitor has made a claim and did all the paper work for me. He recenlty phoned me and said that i will get the money, the only wait is the insurance company to sign it. How long do you think it will take for the insurance to get my compensation?

  2. It depends what you are claiming for.

    As youhave a solicitor involved I assume two things:

    1. You have an injury and are claiming against an at-fault third party.

    2. You have third party cover, therefore can't claim on your own policy and are claiming against a third party for the cost of repairs or the value of our vehicle if it's been written off.  

    If it's 1, then it can be anything from a couple of months for a simple whiplash claim to well over a year for a more serious injury.

    If it's 2, then I'd expect a pay out soon. It may be worth chasing the insurance company yourself. Get their claims line number, ask to speak to the third party claims department.

    To be honest, solicitors can be helpful but are notoriusly slow in dealing with claims. One of the main reasons for this is that the more hours they put into a claim, the more fees they can bill to the insurers!

    You are absolutely entitled to contact the third party insurers, they will speak to you and you'll probably find they are more likely to deal quicker rather than have to speak to you every couple of days as you chase it up.

    Another good tactic is to ring them and threaten to make a complaint if they don't pay you out soon. Two months is too long if it's  only a claim for vehicle damage or a write off.

  3. I'm over 6 weeks since agreeing upon a price for my car - and still a -waiting.

    Every week they tell my attorney "the check is in the mail" check heck I've yet to recieve paperwork or forms of any sort.  - I don't see me getting a dime any time in the future.  Which is bad for me cus I can't take the kids to the DR or anything like that - I don't have a farkin' car -

I am not exactly clear on what you mean by the insurance company has to "sign it".  Sign what?  The insurance company does not sign anything unless your were injured at work and also have a WC claim.  The Department of Industrial Accidents needs to approve the third party settlement.  That is the only time I ever signed anything other than setting up an annuity.

    If your attorney submitted a demand package, the adjuster will evaluate the claim.  They will contact your attorney and make an offer.  The offer will be given to you.  If it is rejected, the negotiations will continue until the case is settled.  If the negotiations reach an impasse, arbitration or mediation should be considered, before suit is filed.

    If you have already settled, and you signed a settlement release, then you will receive your compensation as soon as the adjuster gets the release and issues payment.  Adjusters love to see releases in their daily mail.  It means they can finally close a claim.

  7. it sounds like a personal injury claim if you have a solicitor dealing.  the length of time to resolve is often directly proportionate to the severity of bodily injury.

    Even so simple whiplash can take 6 months.  Bigger claims can take a lot longer.
