I am not really sure of the date that he filed, but I have talked to child support enforcement and they have told me that they have put a hold on his tax refund and stimulus check and I should be getting all of it for back child support. Problem- it's August and I still haven't received it. Just wanted to know if anyone else has had to deal with this and how long they had to wait or if they are still waiting.

  1. he may have intentionally sabotaged it knowing you were going to get it, with the IRS, stalling is completely acceptable, any change to anything can add 6weeks + waiting

  2. It can take up to 6 months.  If FMS doesn't know his filing status they must sit on it for 6 months to give any current spouse the opportunity to file an Injured Spouse claim.  If they do have his filing status it's usually about 4 to 6 weeks from capture to your hands, depending upon how quickly the local child support enforcement agency acts.

  3. You can plan on at least six months after he files his return and it is processed.  The IRS will not issue a check to the child support authority until the time limit for appeals have passed.
