today my bf got in a fight with a drunk guy. the drunk was beating him up, choking him, biting out pieces of his hand (sorry for the nasty images). but my bf might go to juvie for breaking the man's nose and knocking out his teeth. i think its stupid that my bf would go to juvie, because he was defending himself. If he DOES go to juvie, how long might he be in there?

  1. It's not that hard to stay out of trouble. Tell your boyfriend to grow up and stay away from people that are trouble.

If you must hang out with him then expect plenty of trouble to come your way as well.

  2. When a juvenile is taken into custody, as long as the crime is not too serious, he/she should be released in a matter of hours to his/her parent/guardian.  If the crime is very serious, he could be held until the next available court hearing where he could be released or held in detention pending the resolution of the charge.

  3. i don't think he will be going at all. first of all, the guy was drunk so the court wouldn't really believe what he would say. second of all he was defending himself from him. he shouldn't do any time. but if he does, probably only a few months

  4. Its self defense.

h**l, legally you can even kill and shoot anyone that breaks into your house (in SOME states, in other states its murder)

    He wont go to jail.

  5. It sounds as if they both might go to jail and/or juvenile detention.  Even if this is a self defense case, the injuries suffered by both parties are serious: broken nose, missing teeth, biting.  This is not your typical fist fight.

If your friend is currently in juvenile detention, he will be arraigned on probably Monday or Tuesday.  In CA, this would be a felony assault with a deadly weapon (fists) and probably a special enhancement for great bodily injury (broken nose and missing teeth).  This case will take some time to prepare if the argument is self defense.  His confinement exposure would be up to 4 years, not including any special enhancements.  If he is already on juvenile probation or supervision, he's not coming home for a while.

  6. Did they arrest him?

If not he is not going anywhere. If they did however I have to wonder how much of the story he tells you is true?

I mean I just do not see some drunk guy walking up and starting to beat up a kid.

Most drunks even when drunk know that is serious time.

However i know many teens who thinks it is cool to jump and abusive and beat drunk and homeless folks.

So I just wonder about the story'.

If in fact it is proven he did not do anything then he will not go anywhere but if it is the other way around you need to find another BF and move on.
