How many days do the law give a person to move that's getting evicted from there apartment

I just got a eviction notice to move in 3 days now I know the laws differ from state to state I live in cincinnati ohio.

Also i'm getting evicted for nonpayment but my full payment is in the mail it's just late should I causal the check so I can have money to move or what can I do

  2. i would contact the local police department because it depends on the type of apartment you are renting...Most of the time, you receive a letter that is hand delivered by the sheriffs office, and that is the right date...but if its just the landlord, then I would ignore. Because they have to actually go downtown and pay fees in order to evict you...so contact the sheriff department immediately...and, Yes I would cancel the check based on whatever the police tell you when you call.

  3. Well, if the NOTICE says eviction takes place in 3 days, that's how long you have !!  I know in California, the PROCESS takes 90 days, so it's not like you had no warning.

    We evicted a tenant... and after the notice was served, the Sheriff had to arrive to remove the tenant.

  4. Who is the notice from, the court or the Manager of the apartment? Many landlords think they can send their own eviction notices without court hearings. They are wrong. If the notice is not through the court, the Police or Sheriff will not assist in helping the manager with it.

  5. in the state of ohio a 3 days notice does not mean much. if you have received a court date for judgment against you then start to worry. after the court date then you should have 14-30 days depending on the judge to vacate the premises. if this notice is not from the court but is from your landlord call him or her and let them know the payment is coming in the mail and you should be fine.good luck

  7. Well I'd guess it is 3 days if that is what they are giving you. Don't cancel the check though. I understand the thought, BUT you'd have to pay a check cancellation fee PLUS the pay what you owe at some point. The best you could do is talk to the landlord and see if they will give you another chance.
