Question:

How many hours till break time at work ?

My boss says on saturdays 8am to 12pm that there is no law that says you get a 15 min break. Is that true ?? I thought every 2 hours you get a break. I am not familiar with florida law....could I sue the company or something like that if I challenge them and they fire me ?

  1. That is a 4 hour period of time and you would then be eligible for a 15 minute break.  

    IF and only IF you can PROVE you were fired for questioning this you could POSSIBLY have a suit then you would need to prove your actual damages.

    But they can basically fire you for whatever reason they so desire except a few discrimination issues and barring the presents of a contract.


  2. Florida does not require breaks for adults.

    for minors the requirement is 30 minutes uninterrupted for a shift of longer then 4 hours.

    since the employer is correct you would be insubordinate and if terminated you not only couldn't  sue but  you also would not qualify for unemployment.

    IF they were wrong and fired you for insubordination you would be able to sue under the protections of retaliation for claiming a legal protection or reporting an illegal activity BUT......they are not wrong so that is a moot point.

  3. Every 4 hours a 10 min break / one half hour lunchbreak
