I was hit by a car sitting on the curb by a 14 year old girl with no license > but her parent have insurance

  1. Every claim is evaluated on it's own merits. Things considered are the amount of damage to both of the cars, the injuries incurred, the treatment rendered, any permanency, the venue/jurisdiction involved, the type of negligence laws in effect at the time, if the state is a pip state or not......just to name a few.

    You did not provide us enough information to answer. No one here can give you an answer.

    As long as you don't plan on over treating...running up a bunch of unnecessary medical bills in some flawed attempt to increase your medical bills to try and get a better settlement, you should be fine.

    Also -- folks will tell you 3X the medicals. Get that idea out of your head now.  Very Very Very few insurance companies actually pay 3X the meds and almost never on soft tissue claims.

  5. You didn't just win the lottery, your car got hit by another car.  If you aren't hurt why would you sue.  I hope you aren't one to complain about their insurance rates, because that kind of mentatlity is exactly why insurance premiums are so high

  7. were you hurt?  if the insurance covered your car and your injuries, why would you need to sue?
