How much child support will I get now?

In 2005 I took my ex to court for child support for my 6 year old child..and last week I filed a modification for support due to my child's expenses increasing. Well my ex use to get paid hourly then but now has a new job and gets commission pay only. I'm so confused on what they may do now. Some weeks he gets a paycheck and some if he doesn't sell anything he doesn't get one. Do you think maybe they will just base it on last years taxes. Well I live in NY state if that helps. Thanks

  1. usually they will base off pay checks but they can use previous yr taxes...in texas regardless of when they rec a check they have to pay so much each month...he is resp for making sure it gets to you through office....if this doesn't help my next suggestion would be to call the office your divorce went through or local attorney general office one of them would know the answer


  2. I would suggest to talk with your lawyer or someone who knows the facts other than yahoo answers. It sounds like you might not be getting much because of the way his pay goes right now but they will most likely work something out because he has a 6 year old and the court doesn't take that lightly. As far as I know, it is based on his salary so you guessed it, if he isn't getting anything neither will you. Good luck!

First off, it's not how much child support YOU will get, it's for your child.  If your ex doesn't have a consistent income, they will use his income as reported to the IRS when he filed taxes as their basis for determining support.  It doesn't matter if the expenses for the child have increased.  That's not considered.  The number of children and the incomes of you and your ex are all that's considered.  How the money is managed is up to you.

  6. Go to your superior court web site, look for Child Support Calculator- it's done by a formula based on income. Be aware that if your income has increasd, they will factor that in too!
