  1. While that is true, it also depends on the definition of total and partial disability by your insurer.

Just an FYI, most companies only cover about 60% of your monthly income on their disability coverage. At that, if you do not contribute towards the coverage, the monthly benefit is then taxed. So, in essence, you may only receive 40% of your monthly salary. This is a main reason many people should have a supplemental disability policy. They are usually cheap, around $30 per month, give or take.

  2. If it's a workers comp claim, it's going to depend on how old you are, and how the loss of mobility will affect your future earnings.  If it doesn't affect your future earnings, you aren't entitled to anything.

There's no average.  It depends on your state laws, how the injury happened, and what kind of policy you think might pay out.

  3. Assuming that this is a workers compensation claim.  It all depends, range of motion, flexibility, numbness, tenderness, is it able to bear weight, work restrictions, whether they be permanent or not.

Also depends on what kind of surgery it is.  Are we talking about meniscus tears, ACL, PCL, MCL tears? Total knee replacements?

I've seen knee claims go from $1300-$17,500.  It all depends on how much percentage your friend loses as a whole man.  Sure 35% for the knee, but for whole man, that could be 5%.

  4. It depends on how you hurt the knee.  If it is a workers compensation claim, then most states will have a set schedule for how much you are owed by the insurer.  Outside of that type of coverage, it is really up to either an arbitrator or a judge.  Try to prove as much income loss as you possibly can as a result of the injury.
