Question:

How much control does an Administrator of an estate have?

If all others who have interest in it and want to sell the house, can they hold back the sale of it? Or is there a time limit? There is debt to be paid. This is the state of New York.

  1. Quite a bit but it is based on the laws of the state which the estate was opened.  I would consult the Probate Code of the State your seeking the information for.  Most of that info is online at a ".gov" website.


  2. he has full control unless you contest the will  it will take at least a year for it to go through probate court to make sure all outstanding debts are settled all creditors have 1 year to post a claim against the estate then the house can be sold and any funds minus court costs and inheritence taxes and capitol gains taxes.
