ive been in a commerical accident 3 mths ago. i was in a commerical building/ store front was on 1st floor when the ceiling collapse on my head knocking me out..i woke up and iwas in the ems. mybrother took pics. the place was leaking what appeared to be urine and feasies! i am suffering with neck/back/head aches. i have been taking theraphy for 3mths,,i have a lawyer! now im back to work! i was fully disable.. i still have 3 mths more of therapy. before release and settlement. management company agree to fault and tried to settle with me after 3 days of accident!

  1. 1st off   never ,never sign a release of the accident regardless of how much money you will be getting,your pain can return anytime and the money you get will be paying for treatment 2nd.your attorney will be collecting 1/3 of your funds from the top.you mention 3 more months of therapy, no one can medically say how long that you will be taking it,back and neck injuries are very serious ..your looking at a figure of around 250k and up.


  2. Since you have an attorney, you should ask him this question.  Why else are you throwing a third of your potential settlement out the window.

    Your claim will be evaluated based on the nature and extent of your injury, disability(partial/total), treatment and permanency, if any.  Not having the medical records available for review, makes evaluating your potential settlement impossible.  Your medical expenses and lost wages will be included.  

    I would not be surprised if liability becomes an issue.  Your attorney needs to prove that the management company and/or building owner had notice of a hazard and failed to remedy.

    Edit - read prior post.  You will not recover anywhere near $250k.  Even if you were totally disabled for three months, and partially disabled for 3 months.  Sounds like you sustained a soft tissue injury or else you would have mentioned herniations.  And you have to sign a release if you want to settle and receive compensation.
