if my husband had a kid with another baby and he has a family how much money can she get out from him

  1. I assume you meant another woman not baby...BUT there is no answer for this.  Every state is different, but generally speaking, she can probably get up to 50% of his income.  Some judges don't care if he has enough to live on...they tell them to get a 2nd job!


  2. each state has it's own formula...it depends on how many children he has with any given woman and what his income is, and if they were married at the time...he may be on the hook for short term maintenance if they were.

  3. She will get what ever the judge orders him 2 pay if he makes $5000. a month somewhere in the neighborhood of $1300. he should have kept it in his pants and you should leave him.

  5. In Texas, it is based off of the noncustodial parent's income....

    Roughly about 20% (if he has no other children to account for).

    Contact your local child support agency - They should be helpful with the calculation method used.

    Give it up lady!  He HAS to pay!  The amount will be determined by the governing faction by which you live......we aren't sure where you are.

    The state I live in (Illinois) one child is 17% of his GROSS INCOME.....

    Get used to it.  Kid's aren't cheap.

  10. You can check with your local county court system. In my state, it is set depending on both the custodial and the non-custodial parents income, time spent w/ child, insurance coverage...etc.  

  11. depend on how much both of them  make  and what their expenses are and  the child needs like daycare and insurance or all those little things .(living expenses) that is MN law.

  12. what they usually do is have him fill out some forms to find out where he is financially and what he can afford to pay they wont take his whole check but a good portion of it :) plus since your maried they take your income into cosideration also :)

  13. You sound bitter. If he had a child with another women, why on earth are you still married to this man? He is responsible to support this child, and he is going to have to pay her a good portion of his income.

    20 to 50% of his total income (yours included) or possibly more. It all depends on what the judge thinks is fair, and in my opinion i think the judge is going to hit him hard for getting another women pregnant while he is married.
