How much of a notice does my landlord have to give me to vacate the premises when I don't have lease agreement

I have lived at the same place for 6 years and have never had a lease agreement with my landlord. I found a note on my screen door from my landlord stating that they will no longer be renting the property and gave me until August 31st to find another place to live. I wanted to know how much notice a landlord is required to give me?

  1. Normally covered under state law.  You are renting month-to-month, I assume.  Usually 30 days notice is typical.


  2. If you pay rent on a monthly basis, that makes you a month to month tenant.  Your landlord only has to give you one month notice.

    I suggest you start cleaning out closets and drawers and plan a big yard sale.  No sense moving extra stuff.

    Be sure you get the landlord to do a walk thru with you when you turn in your keys.  You may also want to take pictures of the place before you leave.

    Florida:  15 days

    All other states:  30 days

  4. Google your state's landlord tenant laws for a definitive answer. We need your state to answer correctly.

    It is usually one rental period (month) notice, since you are a month to month tenant. No cause or reason is needed and there is no legal defense to fight it.

    The laws vary by state, so it could be as little as 14 days and as many as 60 days.

    Be warned that if you do not vacate per the notice, the landlord can begin the eviction process on September 1st.

    You should try to avoid being evicted because once an eviction is filed against you, finding decent rentals in the future will be extremely tough. Most landlords will not rent to someone with a previous eviction.
