Question:

How much school can I expect my kids to miss?

I plan to leave my husband, and want to transfer the kids to another school, hoping he won't try to snatch them. And I need to file for custody. How many days does it take to withdraw and then re-enroll my kids. I don't want them missing too much school over all this. Is the place where I can file for custody open on the weekends?

  1. You need to have a lawyer in order to file for custody of your children and not many of them have weekend office hours.  As far as unenrolling your children from one school and transferring them to another you can have the school do it.  You will first need the information from the new school they will be attending, name of the school, mailing address, district the school is in, telephone number, fax number and email address.  Take that infomation to the old school and give it to the people in the office with instructions to transfer your kid's transcripts to the new school and request a confirmation from the old school as to when the information was sent to the new school.  Then you will need to contact the new school to be sure they recieved all of the information and find out if there are any further steps you need to take to enroll your children.  But again, you need a lawyer to file for custody because that is done in court.

  2. You need to get custody through a court. They are usually only open during the week.

You can request that the school transfer the files to the new school. You would have to wait for the files to arrive in most cases. Also prove that you are the parent... Showing birth certificates, etc.

You would need the updated medical form showing shots, etc.

You could request to take the files to the new school so you don't have to wait for them to be transfered.

Is shouldn't take more then a few days if its pretty local. If its crossing state lines it could take a week or more depending on how fast they move things along.

  3. You should be able to withdraw them from the present school and  register them in the new school the same day or the next. I am not sure how long you have to register them in the new school cause it probably varies from state to state.  Could you home school in the mean time?   You need to try to get an emergency custody hearing if there is a danger cause you will need the papers if you do not want your soon to be ex to have access to anything to do with the new school.  You will have to file during the week(there maybe places where the court house is open on the weekend but most are closed, call and check) at the court clerks office where you live and they can help you do it yourself if you don't have the money for a lawyer, but it would be in your best interest to try to get one asap after you file.

  4. You need to get a lawyer.  Is there a reason you want to keep the kids from their dad?  Unless he is a danger to them, he will get to see them.  He can file against you to compel you to return the kids to the home.  You really need a lawyer for this.

  5. Custody battles won't happen over a weekend.  You need to go to court for that.  Hiding your kids from their father might not be legal either.  You need to call a lawyer.
