How much time for a concealed firearm?

my cousin is in jail for having a concealed firearm. she has alot of other charges as well. but this is the worst of all. how much time can you get in california????

  1. In general, a weapons offense is a felony under California law, but possession can be charged as a misdemeanor in some cases. The penalties will vary depending on a number of circumstances:

    The type of weapon involved, What was being done with it

    If it was loaded and/or concealed, The individual’s criminal record, drug record or drug use at the time of arrest; Any other factors that might affect the sentence

    California uses a “determinate” sentencing system to offer different levels of punishment depending on the nature of the crime.

    With a felony weapons offense and sentenced to prison, the judge will choose from three prison terms—“low-term,” “mid-term,” and “high-term.” For example, for an assault with an assault weapon, the low-term is four years in prison, mid-term is eight years and high-term is twelve years. With no criminal record, the sentence would most likely be four years.

    For a misdemeanor (such as carrying a concealed weapon with no prior convictions), the maximum allowable sentence is a fine and up to one year in county jail.

    For a misdemeanor (such as carrying a concealed weapon with no prior convictions), the maximum allowable sentence is a fine and up to one year in county jail.

    So, depending on if it is a misdeameanor only, not really a bad time. But, depending on what the other charges are, could go up.  

  5. The answer to your question is a legal one and depends on your state's law, and I am not familiar with Claifornia's concealed carry laws.  You should be able to access your local government on the internet and go to "concealed weapons/firearms."

    If your cousin is facing several charges, and found guilty on each, that could have a determining factor regarding sentencening.

    In most states the violation of concealed firearms violations is a felony; one or more years.  

    You may want to check out what is, exactly, considered concealed carry (CC) in your state, including any additional sanctions regarding CC in restricted areas; i.e.; schools, and etc.

    Your cousin could probably tell you what you want to know, if not, your cousin's attorney should provide your cousin that information ASAP.
