hello i had an accident last week someone backed into my car as i pulled into a parking spot last week, they put a big dent in my rear passenger side door. the other guy obviously didnt see me, well i have talked to the insurance company a few times last week and they said they are still trying to get ahold of the guy, and then they told me that they will send him 2 letters if they dont here from him in 10 business days and if they hear nothing, his insurance will pay my damages. so is it ok for me to check on the status of my claim? if i dont hear from anyone? in a couple days? i really want my car fixed, and i will fight to the max to get it fixed at the fault of the other driver

  1. They will normally wait to accept liability until they get a statement from their insured.  I'm really surprised that they told you they would repair your damages if they don't hear from them.  I hope you understood them correctly.  Many times if they don't hear from their own policy holders, they will decline the claim until they get ahold of them.

My opinion, go through your own carrier.  Have the vehicle repaired and then your insurance approach the other party.  Makes it so much simpler.

If you don't have insurance or collision coverage, I would find a body shop of choice and get an estimate to give them.  Otherwise, your going to have a field inspector come to your residence and give a 'cosmetic' estimate.  After your vehicle gets into the shop, if they find more damage it's hard to get the other insurance come out and approve the supplemental.

  2. I would wait the 10 days and then follow up. To follow up before the 10 days runs out will not do you much good as the adjuster will just tell you they are waiting for the 10 days to run.
