How often will a judge not accept the District Attorneys offer?

There are 5 misdemeanors. The DA is making an offer of required probation with no jail time. Does the judge normally go along with the DA's offer??

  1. Normally, yes. Provided the deal is legal. (ie, it has to fall into the sentencing options for the crime committed.)

    Typically, the Judge will override the deal if the crime is heinous and the punishment light and there is a miscarriage of justice.

    A normal deal for some misdemeanors will likely not get overridden.
