How old do you have to be to decide who you want to live with?

Hi.

My mom and i don't get along very well and i want to go live with my dad. My mom has hit me but i wouldn't say i was abused. My dad has never hit me unless he was spanking me with the belt. I need to know how old you have to be to decide who you want to live with? (In Arizona). My dad has always obeyed the custody rules. I'm 12 years old and i'm taking matters into my own hands. I want to go to court and tell the judge my story. Please help me

In Australia the age to choose is either 12 or 13. I'm sure it's one of them as I went through the same things with my parents but I was too frightened to move in with mum until I was almost 15 because I thought my dad would disown me... Turns out he did... Took me out of his will and burnt all of my possessions.

But I'm happy :)

umm...get your friends parents or someone like that to help you talk to a lawyer cause im sure your mom wont let you...and go on from there

I'm sure if you explained the situation that the court would rule in your favor. Sounds like you would be better off living with your dad.

Wow you sound really smart for 12 years old. Your mom shouldn't hit you and your dad with the belt is just as bad. But if you really want to move out talk to your dad about it. Maybe he can arrange things. If your mom goes off the wall about it then you should call 1-800-842-2288. Just tell them your story and how old you are. They should help you from there. Good luck!
