How old does my child have to be when he doesnt have to visit his father?

My child is 13 and he does want to visit his father anymore. We have been divorced for ten years and my son hates going for visits. The father knows he doesnt want to come over and stay, but he doesn't care. I don't want him to not see his father but I feel like I am forcing him to go there. Does anyone know what the age would be legally when he wouldn't have to go for overnight stays. Thank you

  1. There has to be a reason why he doesn't want to see his father. I'm sorry the two of you are going through this ordeal.

    I would suggest you go to the courts and discuss with the judge that your child would rather stay with you. Or talk to a lawyer.

If you live in the US, 18 is the age at which he gets to choose.  Until then, if there’s a court order for visitation (I assume there is), he has to go.  If there’s a valid reason he doesn’t want to go (ie Dad's abusive, a drug user, etc) then you can go back to court and request that the visitation order be modified.  But without a valid reason the court will not (and should not) deny a parent the right to visit/maintain a relationship with their child.
