Question:

How serious does a back injury from being rear ended need to be in order to sue?

I was at a stop light and was rear ended by another car doing approx 20-30mph. I went to doc and been seeing a physical therapist. I have a strained lumbar. The pain isnt excruitating but at times(driving and sitting for long periods) it does hurt. Can I sue? Is it even worth my time for what I'd get? Any info at all is apprecitated.

  1. You can sue for any costs not covered by your insurance, plus any lost wages, plus pain & suffering.

    Their insurance company may want to settle out of court - but I would use a good injury lawyer (ambulance chaser).


  2. This is ridiculous, if you arent in that much pain than why are you sueing!?! People are always looking for the easy way to make money, but that isnt fair OR good for our economy. Go out, get a job, and work for your money like everyone else.  

  3. It doesnt have to be that bad. You could sue for no back damaged.

    1.Back Damage

    2.Car Damage

    3.Missed Day of pay (if it was on a work day)

From a lawyer.  Our minimal requirements to sue is at least $2000 in property damage and medical bills of $2500.  You should know that injuries like yours can get worse requiring surgery at some point in the future.  I would wait until you are sure about your future medical situation before you settle.  I would recommend that you have an MRI to rule out a herniated disc before you settle.  All tests count as medical expenses.  We normally get our clients 3 to 10 times the amount of the medical bills plus lost wages.  Our fee is one-third of the total recovery.  This is standard for most law firms.  If you don't get a lawyer you will be lucky to get them to pay your medical bills, period.

  5. you can only sue if you can show damage.  For large sums you need to show permant damage.  If you get a sympathetic judge you might be able to recoup any out of pocket medical expenses.  But an expert witness will testify that your pain will eventuall go away after physical therapy is completed....../
