How to beat a speeding ticket?

im a minor(16 going on 17) and have a provisionall drivers license.

i was pulled over for going 66 in a 40 mile zone.

is there anyway to beat it??

  1. Just go to court and when asked to state your name for the record, ask if stating your name enters you into a contract with the court.

    When asked again, don't state your name, say you are a flesh and blood living man or woman, NOT PERSON, and that you are here on the matter of the ticket.  

    The only law is contract, and Maritime Admiralty, the law of commerce, only applies to commercial entities and thus does not include you in its jurisdiction as a flesh and blood, living, sentien MAN.

  3. Well, if you can't prove you weren't speeding ... you probably will not beat the ticket.

    Your provisional license might get revoked or suspended over this one infraction, 26 MPH over the limit in a 40 zone is way too fast!

    Check with your state DMV, in NY your license would be suspended for a violation like that.

In California, you are not necessarily speeding if you are exceeding the posted speed limit.  You are legally speeding only if you are traveling at an unsafe speed, which may or may not be faster than the speed limit.  It's just that going faster than the speed limit is presumed to be speeding, but you can rebut with evidence that your speed was safe.

    If there was no traffic, a sunny day, good visibility, then you could likely argue that 45, 50, maybe even 55 was safe in that 40 mph zone.  The speed limit is based on "average" road conditions.  But 66?  No judge is going to buy that.

    Yes, you can do traffic school.  You still need to pay the fine, but the violation won't appear on your record, and thus won't raise your insurance rates.  Go to the court website for your particular county.  There should be traffic school information there.

    BTW, my answer is based on what existed 20 years ago.  Not sure what the rules are these days.  But, considering California has done just about everything except outright prohibit minors from driving, you might not have the traffic school option available.  Check with the court.

  5. You can go to court and plead not guilty. I don't give you a chance in h**l though. Police cars have cameras that will be used in evidence that will show your speed. Plus you'll have to face the police officer that pulled you over.

  6. The only way to beat it is to prove you were not speeding. That will be difficult, as the officer's testimony almost always carries more weight.

    Any other suggestions you hear, such as hoping the officer doesn't show, are a shot in the dark at best, and rarely effective.

    You were written up for 26 MPH over the speed limit and you have a provisional license.  You will probably not have a license when you leave court.  

    Why should you have a license - its a privilege not a right.

    If you can't do the time, don't do the crime.

  8. its near impossible, if i were you i would plead guilty...and talk to a DA and see what you can do, maybe a defensive drivers course
