How to collect a debt in another state?

I received a judgment by the court against someone for a debt they owed me. When I received the judgment, the debtor lived in NJ. However, he's recently moved to PA. Do I need to file something with the court in PA to collect? How can i go after him? thanks!

  1. Was this judgment by default or is it a summary judgment?

    What you would need to do is, domesticate the judgment. I have forms that I create for myself, but posting them, would be considered Unlicensed Practice of Law.

    PA is very restrictive on what you can and can not do. For instance, you can not garnish wages. But you can do a bank levy. You need to get an exemplified copy of the judgment to file it. But that is all I can say.

    I would suggest you call up the court and ask the court clear what their specific procedure is.  They may have a form that they use already, but the law doesn't specify you have to fill out one...just supply an affidavit.  

    If it's like in Michigan, you also pay a court fee.  The clerk should be able to explain all of this.

    By the way, occasionally you run into a lazy clerk who doesn't want to spend the time helping you out...and they say they are prohibited from giving out legal advice.  Simply inform them you are asking for court procedure, not legal advice, and maybe their supervisor could be more helpful.
